DMCA Policy

ProperResponse (properresponse.com) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"). This policy describes how to report alleged copyright infringement and how we respond to such reports.

1. Safe Harbor Notice

ProperResponse qualifies for the DMCA safe harbor for service providers under 17 U.S.C. § 512(c). We store content uploaded by users (documents, files, and case materials) and do not independently review or select that content. If you believe content stored on our platform infringes your copyright, you may submit a takedown notice as described below.

2. How to Submit a DMCA Takedown Notice

To report alleged copyright infringement, send a written notice to our designated DMCA agent (contact below) that includes all of the following:

  1. Your full legal name, mailing address, telephone number, and email address.
  2. A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
  3. The specific URL or other information reasonably sufficient to identify the location of the allegedly infringing material on our platform.
  4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Your physical or electronic signature.
Warning — Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including attorneys' fees. Submit notices only for content you have a good-faith, reasonable basis to believe infringes your copyright.

3. Our Response to Valid Notices

Upon receipt of a complete and valid DMCA takedown notice, we will:

  1. Promptly remove or disable access to the allegedly infringing material.
  2. Notify the user who uploaded the material that it has been removed.
  3. Provide the user with a copy of the takedown notice (with your personal contact information redacted if requested).

4. Counter-Notice Procedure

If you are a user whose material was removed and you believe the removal was in error or based on misidentification, you may submit a written counter-notice to our DMCA agent that includes:

  1. Your full legal name, mailing address, telephone number, and email address.
  2. Identification of the material that was removed and its prior location on the platform.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district where you are located (or, if outside the United States, any judicial district in which ProperResponse may be found), and that you will accept service of process from the person who submitted the original takedown notice.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the material within 10–14 business days unless the complainant notifies us that they have filed a court action seeking an injunction.

5. Repeat Infringers

ProperResponse will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances, consistent with 17 U.S.C. § 512(i).
